Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website measr.app and the Measr analytics toolkit (collectively, the "Service") provided by Creative Data Engineers LLC ("Company," "we," "us," or "our").
By purchasing or using the Service, you ("User," "you," or "your") agree to be bound by these Terms.
1. Who We Are
Creative Data Engineers LLC is a U.S.-registered single-member LLC providing analytics tools and consulting services globally.

2. Description of Service
Measr is a self-hosted analytics toolkit consisting of a tracking SDK, Supabase database migrations, and a React dashboard application. You purchase a subscription license that grants access to the private GitHub repository containing all source code and documentation.
The Service is self-hosted: you deploy Measr to your own infrastructure (Supabase project, Netlify or other hosting). We provide the code; you run it.
3. Subscription and Payment
- Subscriptions are available as monthly (currently EUR 39/month) or yearly (currently EUR 390/year) plans.
- Payments are processed via Stripe.
- Prices may change. Existing subscribers keep their rate for the duration of their billing cycle.
- Founder pricing (MEASR-FOUNDER coupon) is honored for the lifetime of the subscription as long as it remains active.
4. Repository Access
- Upon successful payment, you receive a GitHub collaborator invite to the private Measr repository within 24 hours.
- Access is personal. Do not share repository access, source code, or built artifacts with third parties.
- If your subscription ends (cancellation or failed payment), repository access is revoked.
- Code you have already deployed continues to function. You retain the right to run deployed instances but not to receive further updates.
5. Self-Hosted Nature
- You are responsible for your own deployment, including Supabase configuration, hosting, and security.
- Data collected by your Measr installation stays in your infrastructure. We have no access to it.
- We provide documentation and setup tools but do not guarantee that the toolkit will work in every environment.
6. Cancellation and Refunds
- You may cancel your subscription at any time via the Stripe customer portal.
- Cancellation takes effect at the end of the current billing period.
- Refund requests are handled on a case-by-case basis. Contact support@measr.app.
7. Intellectual Property
- Source code: the Measr source code is provided under a proprietary license. You may deploy and modify it for your own use. You may not redistribute, sublicense, or sell it.
- Your data: any data collected by your deployed Measr instance belongs to you.
- Your modifications: modifications you make to your deployed copy are yours, but you may not distribute them.
8. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages.
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
- We do not guarantee the accuracy of analytics data collected by your deployment.
- We are not responsible for data loss in your Supabase instance.
9. Disclaimers
The Service is provided "as is." We make no guarantees that:
- The toolkit will be error-free or continuously available
- Third-party services (Supabase, Netlify, GitHub) will remain operational
- The analytics data collected will meet your specific requirements
- Updates will maintain backward compatibility (though we aim to)
10. Governing Law
These Terms are governed by the laws of the State of New Mexico, USA. Where required by GDPR or applicable EU consumer protection laws, local mandatory regulations also apply.
11. Changes to These Terms
Updates will be posted at measr.app/legal/terms-of-service.html with an updated effective date. Continued use constitutes acceptance.
